Trump administration sues California over laws protecting immigrants

The administration believes the law restricts state and local law enforcement from voluntarily providing information to federal immigration authorities about the release date of removable criminal aliens who are in their custody.

The administration has lost in a lot of them, especially in its efforts to restrict immigration from a number of mostly Muslim countries.

Brown responded in a statement by calling the lawsuit a "political stunt". DOJ will also seek declaratory judgement that these laws are unconstitutional - "preempted" by federal immigration law - when it files late Tuesday night.

De Leon also described the lawsuit as a "racist and xenophobic attack", writing, "If Sessions is serious about cracking down on crime, he should stop fretting about CA and look in his own backyard".

The Justice Department's planned lawsuit against California will target three state laws, senior Justice Department officials said on Tuesday in a press briefing.

Last month U.S. Immigration and Customs Enforcement said hundreds of immigrants eluded detention because of a warning from Oakland's mayor.

"At a time of unprecedented political turmoil, Jeff Sessions has come to California to further divide and polarize America", he said in a statement.

The suit named Brown and state Attorney General Xavier Becerra, both strident defenders of undocumented immigrants, as defendants.

"Despite how (bill author Senate President Pro Tem Kevin de León) has presented the issue, the law enforcement profession, which CPOA represents, can not and does not engage in immigration enforcement".

Politico reported Tuesday that the suit will focus on three laws passed within the California state legislature past year in opposition to President Donald Trump's promised crackdown on undocumented immigration.

"The provisions of state law at issue have the objective and effect of making it more hard for federal immigration officers to carry out their responsibilities in California", Justice Department lawyers wrote. Many state and local officials in California say the administration's stepped-up deportation efforts are making communities less safe and undermining local economies. "I appreciate the efforts of Attorney General Jeff Sessions and the Department of Justice to uphold the rule of law and protect American communities". We have no intention changing that here in California.

"We do, however, have a sworn duty to protect our communities from the release of potentially unsafe criminals, wherever they may come from", said current president of CPOA, Beverly Hills Police Department Assistant Chief Marc Coopwood in a September statement.

Carol Leveroni, executive director of the 20,000-member California Peace Officers Association, said they invited Sessions in hopes of gaining clarity on how law enforcement can follow California's sanctuary state law, Senate Bill 54, while still following federal mandates.
