SC asks govt to take call on national anthem in cinema halls

SC agrees to hear review petition on standing during 'Jana Gana Mana' in cinema halls

In response to a petition challenging the playing of National Anthem in cinema halls, a Supreme Court bench comprising Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud said that it is up to the central government to take a decision on the matter.

According to media, that court direction to centre came as refuse to change earlier order which made it earlier order that made it mandatory for cinema halls to play the National Anthem before the start of movie screenings. "In our opinion, it is appropriate that Centre takes a call in this mater, and if necessary, as advised, it may think of issuing a notification or circular or Rules by using its discretion without being influenced by our November 30 order". The court said that it was fundamental duty of every citizen to respect National Anthem and National Flag and it was desirable that anthem was played in public events but judiciary should not step in to make it mandatory in cinema halls.

The court also banned the printing of the anthem or a part of it on any object and displaying it in a manner that may be disrespectful or "disgraceful to its status". On this, the court wished to know the stand of the Centre on this issue. Later, in December, the court modified its order to say that handicapped persons need not stand up.

People go to cinema for undiluted entertainment. Justice Chandrachud was particularly critical of earlier order and said that moral policing on the name of patriotism should not be allowed. "Where then can we draw the line on moral policing", said Justice Chandrachud, who was most vocal in demanding Government to respond.

Lashing out at the government for supporting the SC order which made it compulsory to stand up for the anthem, Justice Chandrachud said that the government should take its own stand on whether people should stand up for the anthem. These are all matters of entertainment.

However, Centre has expressed support for the singing of the anthem, stating that it will instil a feeling of unity in a diverse country with many castes and religions. Why do you have to throw the burden on the court?

He further said, " next you will want people to stop wearing tees and shorts to the cinemas saying this is disrespect to the Anthem.
