Google appeals against 2.4-billion euro fine in EU court

Google is still obliged to pay up despite the legal challenge, but it can put the money in a locked account until the court reaches a decision.

The Commission told Google to stop displaying its shopping service so prominently at the top of search results by September 28, saying it is an abuse of power. The company declined to give further details of its appeal.

The EU competition enforcer will defend its decision in court, a spokesman said.

The fine was the largest penalty ever issued by the regulator, which also said the firm could face more fines if it continued its practices.

It is anticipated to take years before the Luxembourg-based General Court rules on the case.

The Commission is reviewing its Google Shopping decision in light of the ECJ's Intel ruling, according to Reuters. "And most importantly, it denied European consumers a genuine choice of services and the full benefits of innovation".

Google may have been emboldened by Intel's recent success in appealing a €1.06 billion antitrust fine - the previous European Union record - imposed by the Commission in 2009.

Brussels accused Google of giving its own service too much priority in search results at the expense of other price comparison services, such as TripAdvisor and Expedia.

The fine over Google Shopping broke the previous European Union record for a monopoly case against USA chipmaker Intel of 1.06 billion euros in 2009 and made the EU the global leader in regulating Silicon Valley giants. The first relates to Android, its operating system on a smartphone, and the second AdSense, its advertising network.
