Trump administration amends travel ban date to keep legal battle alive

US President Donald Trump's revised travel ban was served another defeat as a second appeals court blocked his executive

The petition also asked the Supreme Court justices to determine the legality of the executive order. Two federal appeals courts have since upheld those lower court orders.

Then, on June 12, the Ninth Circuit issued a decision on the Hawaii case The court's opinion stated that it did not need to rule on whether the travel ban violates the constitutional guarantee of religious freedom, because the executive order also exceeds the power Congress has given to the president to regulate immigration.

Federal judges in Maryland and Hawaii blocked Trump's 90-day ban on travellers from Libya, Iran, Somalia, Sudan, Syria and Yemen.

"President Trump knows that the country he has been elected to lead is threatened daily by terrorists who believe in a radical ideology, and that there are active plots to infiltrate the U.S. immigration system - just as occurred prior to 9/11", Sessions said in a statement on Monday. "I think we can all attest that these are very risky times and we need every available tool at our disposal to prevent terrorists from entering the United States".

The Supreme Court will decide whether to take the case on Wednesday.

"We disagree with the Ninth Circuit's decision to block that authority", he said, adding that the recent attacks confirmed that threats to the nation are immediate and real. "Unfortunately, this injunction prevents the President from fully carrying out his Article II duties and has a chilling effect on security operations overall".

The White House has consistently argued that the travel ban is well within Trump's powers as president - with Trump himself defending the ban as a necessity in a time of chaos.

The White House released a memorandum Wednesday declaring that the effective date of the president's executive order banning travelers from six Muslim-majority countries "is delayed or tolled" until all relevant court injunctions "are lifted or stayed". "It can not go unchecked when, as here, the President wields it through an executive edict that stands to cause irreparable harm to individuals across this nation".

For the first time since he was elected, President Donald Trump is set to attend the U.S. Supreme Court on Thursday, presenting a potentially awkward moment as the court weighs what to do about his contentious executive order that attempts to restrict U.S. entry by people from six Muslim-majority countries.

Masri noted that CAIR filed an amicus ("friend of the court") brief in the case.

The U.S. Fourth Circuit Court of Appeals in late May upheld a lower court ruling that blocked the implementation Trump's travel ban.
