Trump goes to Twitter to undermine own case in travel ban case

President Donald Trump Monday morning criticized opponents of his executive order banning travel from from six majority Muslim nations, as well as his own Department of Justice and the judiciary.

The Justice Department's June 1 petition for Supreme Court review of the en banc opinion of the U.S. Court of Appeals for the 4th Circuit, holding the travel ban to violate the First Amendment, emphasizes the Trump administration's core argument that the 4th Circuit erred in considering the president's motives.

"That's right, we need a TRAVEL BAN for certain unsafe countries, not some politically correct term that won't help us protect our people!" he said.

These evidently unlawyered ejaculations followed a tweet over the weekend in which Trump linked the need for the "Travel Ban" - terminology his press secretary has foresworn - to Saturday's terrorist attack in London.

Even as legal wrangling over the ban continues, Trump also tweeted on Monday (Tuesday NZT) that his administration was implementing tougher vetting of would-be visitors to the United States, adding: "The courts are slow and political!". Both orders, aimed at temporarily halting entry to the US from a half-dozen Muslim-majority countries, have been blocked by the lower courts. Additionally, the lawyers have tried to create distance between the first executive order and the one that replaced it, which Trump's claim of the second being a "watered down" version of the first won't help.

If anything, the Supreme Court may be more likely to hear the case in light of the tweets, to determine once and for all how far the president's power goes, said Peter Margulies, a law professor at Roger Williams.

"It has nothing to do with religion, or skin colour or the way they live their lives, but all about security for the U.S., nothing else", Kelly said.

Another case related to the second executive order is pending in a Hawaii appeals court, which resulted from the decision of a lower court to block Trump's order.

Trump has presented the measure, which seeks to halt entry to the U.S. for 90 days for people from several predominantly Muslim countries and bar refugees for four months, as essential to prevent attacks in the US.

Multiple federal courts have barred authorities from enforcing the order, saying it amounts to unconstitutional religious discrimination against Muslim, with judges citing as part of their reasoning comments Trump made when he was a candidate for president and before he took office.

"These are countries that (are) either unable or unwilling to help us validate the identities or backgrounds of persons within their borders".

Fox has not said whether he supports the travel ban as good immigration or national security policy.

He also offhandedly dismissed his own lawyers' urgent request to the Supreme Court that the ban be reinstated by asserting that his administration was already performing "extreme vetting" in any case.
